(ו) עֶשֶׂר קְדֻשּׁוֹת הֵן, אֶרֶץ יִשְׂרָאֵל מְקֻדֶּשֶׁת מִכָּל הָאֲרָצוֹת. וּמַה הִיא קְדֻשָּׁתָהּ, שֶׁמְּבִיאִים מִמֶּנָּה הָעֹמֶר וְהַבִּכּוּרִים וּשְׁתֵּי הַלֶּחֶם, מַה שֶּׁאֵין מְבִיאִים כֵּן מִכָּל הָאֲרָצוֹת:
(ז) עֲיָרוֹת הַמֻּקָּפוֹת חוֹמָה מְקֻדָּשׁוֹת מִמֶּנָּה, שֶׁמְּשַׁלְּחִים מִתּוֹכָן אֶת הַמְּצֹרָעִים, וּמְסַבְּבִין לְתוֹכָן מֵת עַד שֶׁיִּרְצוּ. יָצָא, אֵין מַחֲזִירִין אוֹתוֹ:
(ח) לִפְנִים מִן הַחוֹמָה מְקֻדָּשׁ מֵהֶם, שֶׁאוֹכְלִים שָׁם קָדָשִׁים קַלִּים וּמַעֲשֵׂר שֵׁנִי. הַר הַבַּיִת מְקֻדָּשׁ מִמֶּנּוּ, שֶׁאֵין זָבִים וְזָבוֹת, נִדּוֹת וְיוֹלְדוֹת נִכְנָסִים לְשָׁם. הַחֵיל מְקֻדָּשׁ מִמֶּנּוּ, שֶׁאֵין גּוֹיִם וּטְמֵא מֵת נִכְנָסִים לְשָׁם. עֶזְרַת נָשִׁים מְקֻדֶּשֶׁת מִמֶּנּוּ, שֶׁאֵין טְבוּל יוֹם נִכְנָס לְשָׁם, וְאֵין חַיָּבִים עָלֶיהָ חַטָּאת. עֶזְרַת יִשְׂרָאֵל מְקֻדֶּשֶׁת מִמֶּנָּה, שֶׁאֵין מְחֻסַּר כִּפּוּרִים נִכְנָס לְשָׁם, וְחַיָּבִין עָלֶיהָ חַטָּאת. עֶזְרַת הַכֹּהֲנִים מְקֻדֶּשֶׁת מִמֶּנָּה, שֶׁאֵין יִשְׂרָאֵל נִכְנָסִים לְשָׁם אֶלָּא בִשְׁעַת צָרְכֵיהֶם, לִסְמִיכָה לִשְׁחִיטָה וְלִתְנוּפָה:
(ט) בֵּין הָאוּלָם וְלַמִּזְבֵּחַ מְקֻדָּשׁ מִמֶּנָּה, שֶׁאֵין בַּעֲלֵי מוּמִין וּפְרוּעֵי רֹאשׁ נִכְנָסִים לְשָׁם. הַהֵיכָל מְקֻדָּשׁ מִמֶּנּוּ, שֶׁאֵין נִכְנָס לְשָׁם שֶׁלֹּא רְחוּץ יָדַיִם וְרַגְלָיִם. קֹדֶשׁ הַקֳּדָשִׁים מְקֻדָּשׁ מֵהֶם, שֶׁאֵין נִכְנָס לְשָׁם אֶלָּא כֹהֵן גָּדוֹל בְּיוֹם הַכִּפּוּרִים בִּשְׁעַת הָעֲבוֹדָה. אָמַר רַבִּי יוֹסֵי, בַּחֲמִשָּׁה דְבָרִים בֵּין הָאוּלָם וְלַמִּזְבֵּחַ שָׁוֶה לַהֵיכָל, שֶׁאֵין בַּעֲלֵי מוּמִין, וּפְרוּעֵי רֹאשׁ, וּשְׁתוּיֵי יַיִן, וְשֶׁלֹּא רְחוּץ יָדַיִם וְרַגְלַיִם נִכְנָסִים לְשָׁם, וּפוֹרְשִׁין מִבֵּין הָאוּלָם וְלַמִּזְבֵּחַ בִּשְׁעַת הַקְטָרָה:
(6) There are ten grades of holiness: the land of Israel is holier than all other lands. And what is the nature of its holiness? That from it are brought the omer, the firstfruits and the two loaves, which cannot be brought from any of the other lands.
(7) Cities that are walled are holier, for metzoras must be sent out of them and a corpse, though it may be carried about within them as long as it is desired, may not be brought back once it has been taken out.
(8) The area within the wall [of Jerusalem] is holier, for it is there that lesser holy things and second tithe may be eaten. The Temple Mount is holier, for zavim, zavot, menstruants and women after childbirth may not enter it. The chel is holier, for neither non-Jews nor one who contracted corpse impurity may enter it. The court of women is holier, for a tevul yom may not enter it, though he is not obligated a hatat for doing so. The court of the Israelites is holier, for a man who has not yet offered his obligatory sacrifices may not enter it, and if he enters he is liable for a hatat. The court of the priests is holier, for Israelites may not enter it except when they are required to do so: for laying on of the hands, slaying or waving.
(9) The area between the porch (ulam) and the altar is holier, for [priests] who have blemishes or unkempt hair may not enter it. The Hekhal is holier, for no one whose hands or feet are unwashed may enter it. The Holy of Holies is holier, for only the high priest, on Yom Kippur, at the time of the service, may enter it. Rabbi Yose said: in five respects the area between the porch and the altar is equal to the Hekhal, for those afflicted with blemishes or with a wild growth of hair, or who have drunk wine or whose hands or feet are unwashed may not enter there, and the people must keep away from the area between the porch and the altar when the incense is being burned.

הרואה ערי יהודה בחורבנן אומר ערי קדשך היו מדבר וקורע [ואינו חייב לקרוע אלא כשמגיע סמוך להם כמן הצופים לירושלים]: [ב"י]:
(ב) הרואה את ירושלים בחרבנה אומר ציון היתה מדבר שממה וקורע וכשרואה בית המקדש אומר בית קדשנו ותפארתנו אשר הללוך בו אבותינו היתה לשרפת אש וכל מחמדינו היה לחרבה וקורע ומהיכן חייב לקרוע מן הצופים ואח"כ כשיראה המקדש קורע קרע אחר וכל קריעה טפח ואם בא דרך המדבר שאז רואה המקדש תחלה קורע על המקדש טפח ואח"כ כשיראה ירושלים מוסיף על קרע ראשון כל שהוא:
(ב) (ב) בחורבנן - אפילו יושבין בהן ישראל כיון שהישמעאלים מושלים עליהם מקרי בחורבנן:
(א) מִצְוַת עֲשֵׂה שֶׁל תּוֹרָה לְמַנּוֹת שׁוֹפְטִים וְשׁוֹטְרִים בְּכָל מְדִינָה וּמְדִינָה וּבְכָל פֶּלֶךְ וּפֶלֶךְ שֶׁנֶּאֱמַר (דברים טז יח) "שֹׁפְטִים וְשֹׁטְרִים תִּתֶּן לְךָ בְּכָל שְׁעָרֶיךָ". שׁוֹפְטִים אֵלּוּ הַדַּיָּנִים הַקְּבוּעִין בְּבֵית דִּין וּבַעֲלֵי דִּינִין בָּאִים לִפְנֵיהֶם. שׁוֹטְרִים אֵלּוּ בַּעֲלֵי מַקֵּל וּרְצוּעָה וְהֵם עוֹמְדִים לִפְנֵי הַדַּיָּנִין הַמְסַבְּבִין בַּשְּׁוָקִים וּבָרְחוֹבוֹת וְעַל הַחֲנֻיּוֹת לְתַקֵּן הַשְּׁעָרִים וְהַמִּדּוֹת וּלְהַכּוֹת כָּל מְעַוֵּת וְכָל מַעֲשֵׂיהֶם עַל פִּי הַדַּיָּנִים וְכָל שֶׁיִּרְאוּ בּוֹ עִוּוּת דָּבָר מְבִיאִין אוֹתוֹ לְבֵית דִּין וְדָנִין אוֹתוֹ כְּפִי רִשְׁעוֹ:
(ב) אֵין אָנוּ חַיָּבִין לְהַעֲמִיד בָּתֵּי דִּינִים בְּכָל פֶּלֶךְ וּפֶלֶךְ וּבְכָל עִיר וָעִיר אֶלָּא בְּאֶרֶץ יִשְׂרָאֵל בִּלְבַד. אֲבָל בְּחוּצָה לָאָרֶץ אֵינָן חַיָּבִין לְהַעֲמִיד בֵּית דִּין בְּכָל פֶּלֶךְ וּפֶלֶךְ שֶׁנֶּאֱמַר (דברים טז יח) "תִּתֶּן לְךָ בְּכָל שְׁעָרֶיךָ אֲשֶׁר ה' אֱלֹקֶיךָ נֹתֵן לְךָ לִשְׁבָטֶיךָ":
(ג) כַּמָּה בָּתֵּי דִּינִין קְבוּעִין יִהְיוּ בְּיִשְׂרָאֵל וְכַמָּה יִהְיֶה מִנְיָנָן. קוֹבְעִין בַּתְּחִלָּה בֵּית דִּין הַגָּדוֹל בַּמִּקְדָּשׁ. וְהוּא הַנִּקְרָא סַנְהֶדְרִי גְּדוֹלָה. וּמִנְיָנָם שִׁבְעִים וְאֶחָד. שֶׁנֶּאֱמַר (במדבר יא טז) "אֶסְפָה לִּי שִׁבְעִים אִישׁ מִזִּקְנֵי יִשְׂרָאֵל" וּמשֶׁה עַל גַּבֵּיהֶן שֶׁנֶּאֱמַר (במדבר יא טז) "וְהִתְיַצְּבוּ שָׁם עִמָּךְ" הֲרֵי שִׁבְעִים וְאֶחָד. הַגָּדוֹל בְּחָכְמָה שֶׁבְּכֻלָּן מוֹשִׁיבִין אוֹתוֹ רֹאשׁ עֲלֵיהֶן וְהוּא רֹאשׁ הַיְשִׁיבָה וְהוּא שֶׁקּוֹרִין אוֹתוֹ הַחֲכָמִים נָשִׂיא בְּכָל מָקוֹם וְהוּא הָעוֹמֵד תַּחַת משֶׁה רַבֵּנוּ. וּמוֹשִׁיבִין הַגָּדוֹל שֶׁבַּשִּׁבְעִים מִשְׁנֶה לָרֹאשׁ וְיוֹשֵׁב מִימִינוֹ וְהוּא הַנִּקְרָא אַב בֵּית דִּין וּשְׁאָר הַשִּׁבְעִים יוֹשְׁבִין לְפָנָיו כְּפִי שְׁנֵיהֶם וּכְפִי מַעֲלָתָם. כָּל הַגָּדוֹל מֵחֲבֵרוֹ בְּחָכְמָה יִהְיֶה קָרוֹב לַנָּשִׂיא מִשְּׂמֹאלוֹ יוֹתֵר מֵחֲבֵרוֹ. וְהֵם יוֹשְׁבִין בִּכְמוֹ חֲצִי גֹּרֶן בְּעִגּוּל כְּדֵי שֶׁיִּהְיֶה הַנָּשִׂיא עִם אַב בֵּית דִּין רוֹאִין כֻּלָּן. וְעוֹד מַעֲמִידִין שְׁנֵי בָּתֵּי דִּינִין שֶׁל עֶשְׂרִים וּשְׁלֹשָׁה עֶשְׂרִים וּשְׁלֹשָׁה אֶחָד עַל פֶּתַח הָעֲזָרָה וְאֶחָד עַל פֶּתַח הַר הַבַּיִת. וּמַעֲמִידִין בְּכָל עִיר וָעִיר מִיִּשְׂרָאֵל שֶׁיֵּשׁ בָּהּ מֵאָה וְעֶשְׂרִים אוֹ יוֹתֵר סַנְהֶדְרִי קְטַנָּה וְיוֹשֶׁבֶת בְּשַׁעַר הָעִיר שֶׁנֶּאֱמַר (עמוס ה טו) "וְהַצִּיגוּ בַשַּׁעַר מִשְׁפָּט". וְכַמָּה יִהְיֶה מִנְיָנָם עֶשְׂרִים וּשְׁלֹשָׁה דַּיָּנִים וְהַגָּדוֹל בְּחָכְמָה שֶׁבְּכֻלָּן רֹאשׁ עֲלֵיהֶן וְהַשְּׁאָר יוֹשְׁבִין בְּעִגּוּל כְּמוֹ חֲצִי גֹּרֶן כְּדֵי שֶׁיְּהֵא הָרֹאשׁ רוֹאֶה אֶת כֻּלָּן:
(2) Only in Eretz Yisrael are we required to set up courts of law in every district and every city, — — as it is written: "You shall appoint judges … for your tribes in all the cities that the Lord your God is giving you" (Deuteronomy 16:18).
(3) How many regular courts of law are to be in Israel, and how many members should each include? To begin with, a supreme court named Great Sanhedrin is established in the Temple; it consists of seventy-one members, as it is written: "Gather for me seventy of the elders of Israel," presided over by Moses, as it is written: "Let them present themselves beside you" Numbers 11:16-17), thus totaling seventy-one. The greatest sage among them all is appointed their presiding officer, who also serves as head of the academy. He is designated by the sages as Nasi (president), who occupies the position of our teacher Moses. The most eminent member of the seventy is placed second in rank and is seated to the right of the Nasi. He is referred to as Av-beth-din (tribunal chairman). The rest of the seventy are seated in front of both, according to their distinction : the greater in knowledge, the closer he is placed to the left of the Nasi. They sit in the form of a semicircle, so that the Nasi and the Av-beth-din may see all of them.
Two other tribunals, each consisting of twenty-three members, are set up [next to the Great Sanhedrin], one at the entrance of the Temple Court and the other at the entrance of the Temple Mount. Besides, a Small Sanhedrin is set up in every town of Israel with a population of one hundred and twenty or more, and is to meet at the gate of the town, as it is written: "Let justice prevail at the gate" (Amos 5:15). How many members make up the Small Sanhedrin? Twenty-three judges. The most learned man among them presides over them; the rest are seated in the form of a semicircular threshing floor, so that the presiding judge may see all of them.
