Prison Reform - Torah Tuesday

According to the US Bureau of Justice Statistics (BJS), 2,220,300 adults were incarcerated in US federal and state prisons and county jails in 2013 – about 0.91% of adults (1 in 110) in the U.S. resident population. (https://www.bjs.gov/content/pub/pdf/cpus13.pdf)

וַיִּקַּח֩ אֲדֹנֵ֨י יוֹסֵ֜ף אֹת֗וֹ וַֽיִּתְּנֵ֙הוּ֙ אֶל־בֵּ֣ית הַסֹּ֔הַר מְק֕וֹם אֲשֶׁר־אסורי [אֲסִירֵ֥י] הַמֶּ֖לֶךְ אֲסוּרִ֑ים וַֽיְהִי־שָׁ֖ם בְּבֵ֥ית הַסֹּֽהַר׃
So Joseph’s master had him put in prison, where the king’s prisoners were confined. But even while he was there in prison,
וַיִּקְצְפ֧וּ הַשָּׂרִ֛ים עַֽל־יִרְמְיָ֖הוּ וְהִכּ֣וּ אֹת֑וֹ וְנָתְנ֨וּ אוֹת֜וֹ בֵּ֣ית הָאֵס֗וּר בֵּ֚ית יְהוֹנָתָ֣ן הַסֹּפֵ֔ר כִּֽי־אֹת֥וֹ עָשׂ֖וּ לְבֵ֥ית הַכֶּֽלֶא׃
The officials were furious with Jeremiah; they beat him and put him into prison, in the house of the scribe Jonathan—for it had been made into a jail.
כִּ֣י בָ֧א יִרְמְיָ֛הוּ אֶל־בֵּ֥ית הַבּ֖וֹר וְאֶל־הַֽחֲנֻ֑יוֹת וַיֵּֽשֶׁב־שָׁ֥ם יִרְמְיָ֖הוּ יָמִ֥ים רַבִּֽים׃ (פ)
Thus Jeremiah came to the pit and the cells, and Jeremiah remained there a long time.
וַיַּנִּ֥יחוּ אֹת֖וֹ בַּמִּשְׁמָ֑ר כִּ֚י לֹ֣א פֹרַ֔שׁ מַה־יֵּעָשֶׂ֖ה לֽוֹ׃ (ס)
He was placed in custody, for it had not been specified what should be done to him.
מתני׳ ההורג נפש שלא בעדים מכניסין אותו לכיפה ומאכילין אותו (ישעיהו ל, כ) לחם צר ומים לחץ:
MISHNA: With regard to one who kills a person not in the presence of witnesses and it is impossible to judge him in court, the court places him into a vaulted chamber and feeds him sparing bread and scant water (see Isaiah 30:20).
הַהוֹרֵג נְפָשׁוֹת וְלֹא הָיוּ עֵדִים רוֹאִין אוֹתוֹ כְּאַחַת אֶלָּא רָאָהוּ הָאֶחָד אַחַר הָאֶחָד אוֹ שֶׁהָרַג בִּפְנֵי שְׁנֵי עֵדִים בְּלֹא הַתְרָאָה אוֹ שֶׁהֻכְחֲשׁוּ הָעֵדִים בִּבְדִיקוֹת וְלֹא הֻכְחֲשׁוּ בַּחֲקִירוֹת. כָּל אֵלּוּ הָרַצְחָנִים כּוֹנְסִין אוֹתָן לְכִפָּה וּמַאֲכִילִין אוֹתָן לֶחֶם צַר וּמַיִם לַחַץ עַד שֶׁיָּצֵרוּ מֵעֵיהֶן וְאַחַר כָּךְ מַאֲכִילִין אוֹתָן שְׂעוֹרִים עַד שֶׁתִּבָּקַע כְּרֵסָם מִכֹּבֶד הַחלִי:

The following laws apply when a person kills people, but the witnesses did not observe his act together - instead one saw him after the other did: a person killed in the presence of witnesses, but a warning was not given; or the witnesses to a murder contradicted each other with regard to the fine points of the testimony, but not with regard to the fundamental questions.

All those murderers should be forced to enter a kipah. There they are fed parched bread and small amounts of water until their digestive tract contracts. Then they are fed barley until their bellies burst because of the extent of the sickness and they die.

אמר רב יהודה אמר רב כל מה שברא הקדוש ברוך הוא בעולמו לא ברא דבר אחד לבטלה ברא שבלול לכתית ברא זבוב לצירעה יתוש לנחש ונחש לחפפית וסממית לעקרב

On the subject of sores, the Gemara cites a statement referring to one of the methods for healing a sore. Rav Yehuda said that Rav said: Everything that the Holy One, Blessed be He, created in His world, He did not create anything for naught. He created a snail as a remedy for a sore; He created a fly to be crushed and spread as a remedy on a wasp sting; He created a mosquito as a remedy for a snake bite; and He created the snake itself as a remedy for a skin rash; and He created a gecko as a remedy for a scorpion bite.

The ultimate purpose of the creation of the world is that G-d desired to have a dwelling place in the lower realms.

אלא שאין הקב"ה בא בטרוניא עם בריותיו

The Holy One, Blessed be He, does not deal tyrannically [beteruneya] with His creations, but wants them to feel that they have been judged fairly.

…with regards to one who is in prison, such a person is in a very downcast state of being, because he has been taken from his day-to-day life, and in a certain way he is worse-off than a sickly person [i.e. in a hospital], because [at least] an ill person is “in charge” (baal habayit) of himself – at least to the extent that his health allows – but the idea of a prison is, simply, that one is imprisoned and is not “in charge” of himself.
