(ט) וְגֵ֖ר לֹ֣א תִלְחָ֑ץ וְאַתֶּ֗ם יְדַעְתֶּם֙ אֶת־נֶ֣פֶשׁ הַגֵּ֔ר כִּֽי־גֵרִ֥ים הֱיִיתֶ֖ם בְּאֶ֥רֶץ מִצְרָֽיִם׃
(9) You shall not oppress a stranger, for you know the feelings of the stranger, having yourselves been strangers in the land of Egypt.
(א) וגר לא תלחץ. בְּהַרְבֵּה מְקוֹמוֹת הִזְהִירָה תּוֹרָה עַל הַגֵּר מִפְּנֵי שֶׁסּוּרוֹ רָע (בבא מציעא נ"ט): (ב) את נפש הגר. כַּמָּה קָשֶׁה לוֹ כְּשֶׁלּוֹחֲצִים אוֹתוֹ:
(1) וגר לא תלחץ AND THOU SHALT NOT OPPRESS THE STRANGER — In numerous passages (36 in number) does the Torah offer a caution about the ill-treatment of the stranger, because his original character is bad (Bava Metzia 59b). (2) אח נפש הגר [FOR YE KNOW] THE SOUL OF A STRANGER — how hard it is for him when people oppress him.
(א) וגר לא תלחץ. בדין להטות דינו ולמעלה הזהיר עליו אפי' שלא בשעת דין ולכך אמר למעלה לא תונה וכאן לא אמר כי אם לא תלחץ ואגב שאמר לא תטה משפט אביונך אמר כאן וגר לא תלחץ ואחר שאמר לא תטה משפט וגר לא תלחץ אמר אך עבד להו חיות ומידת רחמנות:
(א) וגר לא תלחץ. אזהרה יתירה לב״ד שלא יהיו לוחצים אותו אם הוא ראוי לעונש לא ילחצנו יותר מדי:
(ב) ואתם ידעתם וגו׳. וידעתם את לבו שהוא נמוג בעת שהוא נשפט ואין לו גואל להקל דינו. ע״כ באה אזהרה זו להרחיב את לבו שלא יענש יותר מהראוי אם לא הי׳ גר:
(א) וגר לא תלחץ להטות דינו. ולמעלה הזהיר עליו אפילו שלא בשעת הדין סמכו כאן לפי שאין לו גואלים וקל ונוח הוא ללחצו ולעוותו בדין.
(1) וגר לא תלחץ, “and do not oppress the stranger.” Here too the Torah speaks about the treatment strangers may have to endure at court. In the earlier reference to the stranger, (22,2), the Torah referred to how we are not to treat the stranger in every day life, not when he is involved in litigation. It is repeated here as he is also one of the sections of society that is likely to be taken advantage of as they have no one to stand up on their behalf. It is easy to get away with taking advantage of them.
