משנה: הַנּוֹתֵן לְפוּנְדָּקִית מְעַשֵּׂר אֶת שֶׁהוּא נוֹתֵן לָהּ וְאֶת שֶׁהוּא נוֹטֵל מִמֶּנָּה מִפְּנֵי שֶׁהִיא חֲשׁוּדָה לְחַלֵּף. אָמַר רִבִּי יוֹסֵי אֵין אָנוּ אַחֲרָאִין לְרַמָּאִין אֵינוֹ מְעַשֵּׂר אֶלָּא מַה שֶׁהוּא נוֹטֵל מִמֶּנָּה בִּלְבָד. MISHNAH: He who gives to the innkeeper’s wife, tithes what he gives her and what he takes from her because she is suspected to switch133The motives imputed to the innkeeper’s wife (or the female innkeeper) are not clear. She is supposed to cook for her guests the food they provide. The anonymous Tanna holds that a ḥaver never hands anything demay over to a fellow Jew. This Mishnah (and the next) are quoted in Chullin.6">Babli Ḥulin 6a–b; there, the interpretation is that the innkeeper will try to please her guests and maybe substitute fresher produce or spices for him, whereas R. Yose takes a dim view of innkeepers and thinks that if she takes anything it is in order to steal.. Rebbi Yose said, we are not responsible for the dishonest134If she steals and eats ṭevel, it is her own fault if she commits a deadly sin.; he tithes only what he receives from her.

HALAKHAH: Both Rebbi Yose and Rabban Simeon ben Gamliel135Mishnah Maӓser Šeni 5:1 states that a vineyard in the fourth year (whose fruits may not be eaten without redemption) is signalized by lumps of earth placed around it, and any orchard in the first three years after planting (whose fruits are forbidden for any use) by lumps of clay. Rabban Simeon ben Gamliel notes that this has to be done only in the Sabbatical year, when all growth is ownerless, but that in all other years, when taking from enclosed orchards and vineyards is theft, no signalizing is required since we are not responsible for the salvation of thieves. said the same thing.
