משנה: בְּאֵי זֶה צַד עָשָׂה מַאֲמָר בְּזוֹ וּמַאֲמָר בְּזוֹ שְׁנֵי גִיטִּין וַחֲלִיצָה. מַאֲמָר בְּזוֹ וּבָעַל לְזוֹ שְׁנֵי גִיטִּין וַחֲלִיצָה. מַאֲמָר בְּזוֹ וְגֵט לְזוֹ צְרִיכָה גֵט וַחֲלִיצָה. מַאֲמָר בְּזוֹ וְחָלַץ לְזוֹ הָרִאשׁוֹנָה צְרִיכָה גֵט. MISHNAH: How? If he “bespoke” both of them, they need two bills of divorce and a ḥalîṣah 70By “bespeaking” one of them, he forbade the co-wife for himself (and the other brothers). By “bespeaking” both, he forbade both for himself and has to perform ḥalîṣah with one of them.. If he “bespoke” one and copulated with the other, they need two bills of divorce and a ḥalîṣah71The intercourse was illegal, he may not keep his wife and has to divorce her. The first one needs a rabbinic divorce for her rabbinic “bespeaking”.. If he “bespoke” one and gave a bill of divorce to the other, [the first one] needs a bill of divorce and ḥalîṣah72Giving a bill of divorce to a sister-in-law forbids her and her co-wives to himself. Therefore, he is forbidden to marry the one he “bespoke” and has to free her by both a divorce and ḥalîṣah..
