משנה: קוֹנָם שֶׁאֵינִי נֶהֱנִית לְאַבָּא וּלְאָבִיךָ אִם עוֹשָׂה אֲנִי עַל פִּיךָ. שֶׁאֵינִי נֶהֱנִית לָךְ אִם עוֹשָׂה אֲנִי עַל פִּי אַבָּא וְעַל פִּי אָבִיךָ הֲרֵי זֶה יָפֵר. MISHNAH: ‘A qônām that I shall not take any benefit from my father, or your father, if I shall do anything for you.’ ‘[A qônām] that I shall not have any benefit from you if I shall do anything for my father, or for your father.’ These he can dissolve.
הלכה: קוֹנָם שֶׁאֵינִי נֶהֱנִית לְאַבָּא וּלְאָבִיךָ כול׳. תַּנֵּי. רִּבִּי נָתָן אוֹמֵר. לֹא יָפֵר. וַחֲכָמִים אוֹמְרִים. יָפֵר. מִפְּנֵי מָה הוּא מֵיפֵר. חֲבֵרַייָא אָֽמְרֵי. מִפְּנֵי עִינּוּי נֶפֶשׁ שֶׁלּוֹ. רִבִּי זְעִירָא וְרִבִּי הִילָא תְּרֵיהוֹן אָֽמְרִין מִפְּנֵי נִדְרֵי עִינּוּי נֶפֶשׁ שֶׁלָּהּ. HALAKHAH: “ ‘A qônām that I shall not take any benefit from my father, or your father,” etc. It was stated79Tosephta 7:7; cf. Tosefta ki-Fshutah vol. 7, p. 501; Babli 89b.: Rebbi Nathan says, he cannot dissolve80The reason seems to be that the vow is neither a mortification nor does it hinder marital relations. The Babli gives as reason that the husband cannot dissolve as long as his wife did not work for him because the prohibition did not start. There is no hint of that in the Yerushalmi., but the Sages say, he can dissolve. Why can he dissolve? The colleagues say, because of his mortification81He feels badly about the situation; that is reason enough.. Rebbi Ze‘ira and Rebbi Hila say, because of her mortification82They hold that his being hurt can never be a reason. He gets the power of dissolution because she might be hurt by this in the future..
