משנה: הִנִּיחַ בָּנִים גְּדוֹלִים וּקְטַנִּים אֵין הַגְּדוֹלִים מִתְפַּרְנְסִין עַל הַקְּטַנִּים וְלֹא הַקְּטַנִּים נִיזּוֹנִין עַל הַגְּדוֹלִים אֶלָּא חוֹלְקִין בְּשָׁוֶה. נָֽשְׂאוּ גְדוֹלִים יִשְׂאוּ קְטַנִּים. וְאִם אָֽמְרוּ הַקְּטַנִּים הֲרֵי אָנוּ נוֹשְׂאִין כְּדֶרֶךְ שֶׁנְּשָׂאתֶם אַתֶּם אֵין שׁוֹמְעִין לָהֶן אֶלָּא מַה שֶׁנָּתַן לָהֶם אֲבִיהֶם נָתַן. הִנִּיחַ בָּנוֹת גְּדוֹלוֹת וּקְטַנּוֹת אֵין הַגְּדוֹלוֹת מִתְפַּרְנְסוֹת עַל הַקְּטַנּוֹת וְלֹא הַקְּטַנּוֹת נִיזּוֹנוֹת עַל הַגְּדוֹלוֹת אֶלָּא חוֹלְקוֹת בְּשָׁוֶה. נִישְׂאוּ גְדוֹלוֹת יִשְׂאוּ הַקְּטַנּוֹת. וְאִם אָֽמְרוּ הַקְּטַנּוֹת הֲרֵי אָנוּ נוֹשְׂאִים כְּדֶרֶךְ שֶׁנְּשָׂאתֶם אַתֶּם אֵין שׁוֹמְעִין לָהֶן. זֶה חוֹמֶר בַּבָּנוֹת מִבַּבָּנִים שֶׁהַבָּנוֹת נִיזּוֹנוֹת עַל הַבָּנִים וְאֵינָן נִיזּוֹנוֹת עַל הַבָּנוֹת. MISHNAH: If he left189A father who died intestate. adult and underage sons, the adult ones cannot be provided for190With business suits and tools at the expense of the undistributed estate. at the expense of the underaged, nor the underaged fed at the expense of the adults, but they split evenly191As long as the estate is not distributed, none of the brothers may receive more than any other.. If the adult ones wed192If a brother marries after the father’s death and the wedding expenses are borne by the estate, any other yet unmarried brother has a claim on the estate equal to the expenses of the one who was the first to marry., the underaged may wed. But if the underaged said, we want to have weddings just as you had193During the father’s lifetime., one does not listen to them, because what their father gave them, he gave.
If he left adult and underage daughters194If no sons survive the father., the adult ones cannot be provided for at the expense of the underaged, nor the underaged fed at the expense of the adults, but they split evenly. If the adult ones wed, the underaged may wed. But if the underaged said, we want to have weddings just as you had, one does not listen to them. It is a restriction about daughters which does not exist for sons, that daughters will be fed at the expense of sons195In any marriage, the daughters have a lien on the estate to be supported by the estate until married, Mishnah Ketubot 4:13. Sons may not inherit until the claims of the daughters are satisfied. But in the absence of sons, daughters of all ages have identical claims on the estate. but not at the expense of daughters.
