MISHNAH: A pigeon chick which is found within 50 cubits belongs to the owner of the dovecote; farther away than 50 cubits it belongs to its finder73It is axiomatic that a pigeon chick which cannot yet fly does not move farther than 50 cubits away from the dovecote. Therefore, any chick within 50 cubits belongs to the owner of the dovecote; the rule prevents property disputes about pigeon chicks.. If it was found between two dovecotes, if it is closer to one of them, it belongs to it; in the middle, both [owners] shall split evenly.
HALAKHAH: “A pigeon chick which is found within 50 cubits,” etc. That is, if no public road interrupts between them79This refers to the last case in the Mishnah, if the chick was found between two dovecotes less than 100 cubits from one another.. But not if a public road interrupts between them80One may assume that the chick was lost by a passer-by who gave up hope to recover it; therefore, it belongs to the finder. (Babli 23b/24a).. This is learned from that, and that is learned from this81“That” is Halakhah Bava meṣia‘2:4, Notes 54–55. Something found in an apartment shared by two people has to be advertised; in a hotel frequented by 3 or more people it belongs to the finder.. This is learned from that: if there were two82Dovecotes within 50 cubits of the chick., he has to make it public. That is learned from this: if there were three82Dovecotes within 50 cubits of the chick., it would belong to its finder81“That” is Halakhah Bava meṣia‘2:4, Notes 54–55.
